Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the RentaKo platform, including rentako.phand all associated services, features, and applications (collectively, the “Service”), operated by RentaKo(“we,” “our,” or “us”).

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not access or use the Service.

1. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into a binding agreement. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Account Registration

Certain features of the Service require you to create an account. When registering, you agree to:

  • Provide accurate, current, and complete information.
  • Maintain and promptly update your account information.
  • Keep your credentials confidential and not share them with third parties.
  • Notify us immediately at info@rentako.app if you suspect unauthorized access to your account.

You are responsible for all activity that occurs under your account. We are not liable for any loss resulting from unauthorized use of your credentials.

3. Description of Service

RentaKo is a property rental management platform designed for Philippine landlords, property managers, and their teams. The Service includes:

  • Property & Rental Listings: Tools to manage property and unit records and publish public rental listings.
  • Lease Management: A structured workflow to create, approve, and track lease agreements between account users and tenants.
  • Billing & Invoicing: Automated monthly invoice generation, recurring charge management, and payment tracking.
  • Client Portal: A dedicated view for tenants (Clients) to see their lease, invoices, payment history, and submit repair tickets.
  • Financial Reports: AR aging, income and expense reports, ledger entries, and tax-related records.
  • Repair & Service Tickets: A ticketing system for maintenance requests and service orders.
  • Marketplace: A platform for connecting accounts with service providers for property-related services.
  • Notifications: Email and SMS alerts for billing events, lease milestones, and repair updates.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

4. Important Disclaimer — Platform Records vs. Legal Documents

RentaKo is a management and record-keeping platform — it is not a legal services provider.

  • Lease records created in RentaKo are digital management records. They are not executed legal contracts unless separately signed and notarized in accordance with Philippine law.
  • RentaKo is not a party to any lease agreement between an account owner (landlord) and a tenant (client).
  • Invoices generated by the platform are management tools to facilitate billing. They do not replace BIR-registered official receipts where legally required.
  • RentaKo does not provide legal, accounting, tax, or financial advice. You should consult qualified professionals for compliance with Philippine tenancy law, BIR regulations, and other legal obligations.

5. Account Owner Responsibilities

As the account owner (or administrator), you are responsible for:

  • Ensuring your use of the Service complies with all applicable Philippine laws, including the Rent Control Act (RA 9653), the Civil Code provisions on lease, and BIR withholding tax regulations.
  • Obtaining appropriate consent from tenants whose personal data you enter into the platform.
  • Ensuring that lease terms, billing rules, and financial records you configure accurately reflect your actual agreements with tenants.
  • Managing user access within your account — including restricting access when staff leave or roles change.
  • Ensuring that documents you upload (contracts, IDs, receipts) are accurate and that you have the right to store them on the platform.

6. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

  • Use the Service to violate any applicable Philippine law or regulation.
  • Upload false, misleading, fraudulent, or counterfeit documents or records.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Use the Service to facilitate money laundering, tax evasion, or other financial crimes.
  • Attempt to gain unauthorized access to any part of the Service, other users' accounts, or our infrastructure.
  • Transmit malware, viruses, or any other malicious code.
  • Scrape, crawl, or harvest data from the Service without our express written permission.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Use the Service to harass, threaten, or harm other users.

Violation of these rules may result in immediate suspension or termination of your account and, where applicable, reporting to relevant authorities.

7. User Content

You retain ownership of all documents, records, and content you upload or create within the Service (“User Content”). By uploading User Content, you grant us a limited, non-exclusive, worldwide, royalty-free license to store, process, and display your User Content solely to provide and improve the Service.

You represent and warrant that:

  • You have the right to upload, share, and grant us a license to your User Content.
  • Your User Content does not infringe the intellectual property rights, privacy rights, or any other rights of any third party.
  • Your User Content is accurate and not submitted for fraudulent purposes.
  • You have obtained appropriate consent from any individuals whose personal data is included in your User Content (e.g., tenant records, identification documents).

We do not review all User Content but reserve the right to remove content that violates these Terms or applicable law.

8. Service Marketplace

The RentaKo Marketplace connects account users with independent service providers. We act as a platform intermediary and are not a party to any agreement between account users and service providers.

  • We do not guarantee the quality, legality, or accuracy of services offered by providers.
  • Users are responsible for conducting their own due diligence before engaging any provider.
  • Any disputes between users and providers must be resolved directly between the parties.
  • We reserve the right to suspend or remove providers who violate our platform standards.

9. AI Features — Ask RentaKo, Lease Assistant, AR Insights

RentaKo includes three AI-powered features. By using them, you acknowledge the following:

Ask RentaKo (Public Chat)

  • Ask RentaKo is a free AI-powered information guide available on the homepage without login.
  • Responses are generated by AI and are intended as general guidance on Philippine rental and tenancy matters. They are not legal, tax, financial, or professional advice.
  • You should verify all information with a qualified professional (lawyer, licensed broker, accountant, or relevant government agency) before making decisions.
  • RentaKo is not liable for any decisions made based on Ask RentaKo responses.
  • Ask RentaKo is subject to rate limits (20 requests per hour per IP address) and a per-session message limit.
  • Do not submit personal tenant data, government ID numbers, financial account numbers, or other sensitive personal information through the public chat.

Lease Draft Assistant (In-App)

  • The Lease Draft Assistant provides contextual guidance while you fill in a lease form.
  • It does not generate legally binding lease contracts. All lease records are management records — see Section 4.
  • Suggestions are AI-generated and may not reflect the most current legal requirements. Always review lease terms with a qualified professional before presenting them to a tenant.
  • RentaKo is not liable for lease disputes arising from terms configured with or without AI assistance.

AR & Collection Insights (In-App)

  • The AR Insights panel generates summaries of your overdue receivables and drafts suggested collection messages based on your account data.
  • Draft messages are presented for your review and approval — nothing is sent to tenants automatically.
  • AI-generated collection language is a starting point. You are responsible for reviewing and customizing messages before sending.
  • RentaKo is not liable for outcomes resulting from collection communications you send, whether or not drafted with AI assistance.

10. Subscriptions and Payments

Certain features of the Service may require a paid subscription. Where applicable:

  • Subscription fees are stated in Philippine Pesos (PHP) unless otherwise indicated.
  • Fees are charged in advance on a monthly or annual basis as selected at the time of subscription.
  • Subscriptions automatically renew unless cancelled before the renewal date.
  • Refunds are not provided for partial subscription periods, unless required by applicable law.
  • We reserve the right to change pricing with at least 30 days' notice.
  • Subscription limits (number of units, users, or storage) are defined per plan and enforced by the platform.

If you believe a charge is incorrect, contact us at info@rentako.app within 30 days of the charge.

11. Intellectual Property

The Service, including its design, software, features, trademarks, and content (excluding User Content), is owned by RentaKo and protected by Philippine and international intellectual property laws. You may not copy, modify, distribute, sell, or sublicense any part of the Service without our prior written consent.

The RentaKo name and logo are trademarks of RentaKo. Unauthorized use of our trademarks is prohibited.

12. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

13. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, error-free, or secure at all times.
  • Financial reports, calculations, or records generated by the platform will satisfy all legal or tax compliance requirements without independent review.
  • The Service will meet your specific requirements or expectations.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RENTAKO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR PHP 1,000, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so the above limitations may not apply to you.

15. Indemnification

You agree to indemnify, defend, and hold harmless RentaKoand its officers, directors, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; (d) your violation of any third-party rights; or (e) any dispute between you and your tenants or service providers arising from use of the platform.

16. Termination

You may close your account at any time by contacting us at info@rentako.app. We may suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice, if we believe you have violated these Terms or if required by law.

Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive.

17. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions.

Any disputes arising out of or related to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to the appropriate courts of the Philippines having jurisdiction over the matter.

18. Changes to These Terms

We may modify these Terms at any time. When we make material changes, we will notify you by email or by a prominent notice on the Service at least 15 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

If you do not agree to the updated Terms, you must stop using the Service and may close your account before the changes take effect.
